How to hire in El Salvador: the 4 routes
US companies have three legal routes to hire in El Salvador: setting up a local entity, using an Employer of Record, or engaging independent contractors. For most SaaS teams making a first hire, an EOR or hiring partner is the working default; an entity pays off at sustained volume, and contractors move fast with the steepest reclassification risk.
Hire employees in El Salvador with an Employer of Record (EOR)
Low riskAn Employer of Record in El Salvador is a third-party company that legally employs workers on your behalf, holding the employment relationship while you direct the day-to-day work. The EOR carries the compliance burden; you carry the operational one.
What an EOR handles:
- Spanish employment contracts filed with the Ministerio de Trabajo (MTPS)
- Monthly USD payroll and income tax withholding
- ISSS (social security) and AFP (pension) contributions
- Aguinaldo, vacation premium and severance accruals
- Terminations and year-end reporting
EOR fits best for:
- Teams of one to ten hires
- A pilot before committing to a local entity
- Remote-first SaaS teams testing the market without local operations
EOR pricing in El Salvador is the provider’s fee on top of statutory costs, so ask for both separately. Most global EOR platforms operate in El Salvador, but an EOR won’t find candidates for you.
Hire independent contractors in El Salvador
Highest riskHiring contractors in El Salvador moves fast with little administration, but the country has one of the strictest reclassification standards in the region. The Labor Code presumes an employment relationship when services are provided for more than two consecutive days or when subordination (set hours, fixed location, a single client) is shown, and without a written agreement the burden of proof falls on the company.
Contractor arrangements work for:
- Short-term, deliverable-based projects
- Specialized consulting with clearly bounded scope
- Pilot engagements before formal employment
To pay independent contractors in El Salvador with less exposure:
- Scope every engagement to specific deliverables, not ongoing hours
- Document the absence of subordination in writing
- Avoid exclusivity and fixed schedules
- Require invoices under the contractor’s own NIT, with IVA where it applies
- Have local counsel review any engagement that runs past a pilot
Set up a local entity in El Salvador
You own complianceThe two most common entity types for foreign-owned operations are the SAS (Sociedad por Acciones Simplificada) and the S.A. de C.V. (Sociedad Anónima de Capital Variable). The SAS allows a single shareholder and online setup with minimal capital, which makes it the usual first-entry choice. A branch of a foreign company (sucursal) is also possible.
Setup requires several registrations:
- Constitute the entity through the CNR registry or the MiEmpresa portal
- Obtain the NIT tax ID and NRC (VAT) registration from Hacienda
- Register the workplace with the MTPS
- Register as an employer with the ISSS and the pension system
- Register the foreign investment with ONI where it applies
From the first hire, the Labor Code requires:
- A written contract filed with the labor authority
- ISSS and AFP contributions from the first payroll
- Aguinaldo, vacation premium and severance accruals
An entity fits sustained hiring, local invoicing or a permanent presence. For one to five hires, the administrative load rarely justifies the cost.
Hire through a nearshore hiring partner
Recruiting includedA hiring partner covers the part the other three routes leave to you: finding and vetting the right person. LatamCent recruits inside the networks where bilingual Salvadoran engineers, GTM and operations talent move, then carries the contract, USD payroll and the legal side under a contractor-on-record model, with one invoice each month.
If you’re building a product team, see how our nearshore software development model works across Latin America.
- 21-day average from kickoff to signed offer
- Pre-vetted shortlists with technical and English screening built in
- 60-day replacement coverage on every hire
In short, an entity gives full control and direct compliance, an EOR moves employment compliance to a local partner, and contractors clear fastest with the highest exposure under the two-day rule. A hiring partner adds the recruiting.
What a Salvadoran hire costs in US dollars
El Salvador’s payroll already runs in US dollars, so there is nothing to convert. Enter a monthly salary to estimate employer contributions, the aguinaldo and the vacation premium on top of it.
Cost calculator
ISSS is 7.5% on salary up to $1,000 a month, so it never exceeds $75; the AFP employer rate is 8.75% up to the pension ceiling. On salaries up to $1,000, contributions land at about 16% to 17%; on a $2,000 salary they are about 12.5%. LatamCent hires are priced as salary plus a service fee, quoted per role.
Why a dollarized payroll matters
No exchange rate, no indexation debate
El Salvador adopted the US dollar in 2001. Salaries, contributions, taxes and severance are all calculated and paid in USD, so the number in your offer is the number on your invoice, month after month.
- No FX layer in budgets or contracts
- Offers compare directly with US pay bands
- Inflation was 3.6% year on year in September 2026
- Bitcoin acceptance has been voluntary since a January 2025 reform
Why this matters for hiring
A $2,000 monthly salary costs about $2,358 a month with employer contributions, the aguinaldo and the vacation premium for an employee in the first three years. Add a severance reserve and the provider fee if you hire through an EOR.
Figures are estimates for planning. Confirm rates with your payroll provider before you sign a contract.
Employment laws in El Salvador
Employment in El Salvador runs on the Código de Trabajo, enforced by the Ministerio de Trabajo y Previsión Social (MTPS), with the ISSS and the AFP pension system handling social security. The law favors the employee by default, so the employer carries both the cost and the administration.
Severance is the load-bearing line item. Dismissal without cause from an indefinite contract pays 30 days of basic salary per year of service, proportional for fractions, with a minimum of 15 days. The daily salary used is capped at four times the legal minimum daily wage. Ending a fixed-term contract early pays the remaining salary, capped by the same formula.
Employees who resign voluntarily after at least two years of service are also owed an economic benefit of 15 days of salary per year, with the daily salary capped at twice the minimum wage, under the 2013 voluntary-resignation law.
Build the reserves into the salary model. Severance, the aguinaldo and the 30% vacation premium all scale with tenure.
Onboarding
A written contract in three copies, one filed with the Dirección General de Trabajo within 8 days. Register the work center with the MTPS and the employee with the ISSS within 10 days of the start. The employee needs a NIT.
Contracts and probation
Indefinite contracts are the default and presumed form; fixed-term contracts are allowed only where the law permits. Probation lasts up to 30 days, either side can end it without cause, and the same parties can’t repeat it for the same work within a year.
Notice
There is no general statutory notice scale for dismissal. On separation the employer issues a service certificate with dates, work performed and last salary.
Working hours and overtime
Day work: 8 hours a day and 44 a week. Night work: 7 hours a day and 39 a week, with night hours paid at 25% extra. Overtime is paid at a 100% surcharge, and at least 8 hours must separate work periods.
Aguinaldo
Paid in December: 15 days of salary for 1 to 3 years of service, 19 days for 3 to 10 years and 21 days for 10 years or more, proportional for employees with less than a year.
Income tax
Monthly withholding is 0% up to $550, then progressive at 10%, 20% and 30%, applied after ISSS and AFP deductions. Employees contribute 3% to the ISSS (up to $30) and 7.25% to the AFP.
Minimum wage
$408.80 a month for commerce, services and industry since June 2025, well below market pay for professional roles.
Monthly payroll in El Salvador
Payroll services in El Salvador cover a defined set of recurring obligations:
Paid in USD, monthly or twice a month
Health and maternity coverage, 7.5% employer and 3% employee up to the $1,000 base
Pension contributions, 8.75% employer and 7.25% employee
1% training levy for employers with 10 or more workers
Monthly income tax under the Hacienda table
Aguinaldo, vacation premium and severance reserve
Companies hiring through an EOR transfer payroll execution, withholding and statutory filings to the provider. Entity holders run them in-house, with direct exposure to MTPS audits and ISSS reviews.
Three lines are specific to this market: severance against a capped daily wage, an aguinaldo that steps up with tenure, and a 30% premium on every vacation.
Common benefits and perks in El Salvador
Base salary alone doesn’t close senior offers in El Salvador. Bilingual professionals who have worked with US and regional employers read your package against international reference points, not the statutory floor.
Private health insurance
The ISSS covers the baseline with limited facilities and longer waits for specialists. Private cover for the employee and family is the standard expectation for senior hires.
Additional paid time off
Statutory leave is 15 days with a 30% premium. Competitive tech employers add 5 to 10 days and flexible scheduling.
Performance bonuses
Commissions and quota-linked pay are common, so revenue hires already know the structure SaaS companies use.
USD pay benchmarks
Senior bilingual hires benchmark offers against US pay bands, and dollarization removes the indexation conversation other markets need.
Remote work stipend
Monthly internet support and employer-provided hardware are the floor set by the BPO and services sectors.
Professional development
AWS, Azure and GCP certifications carry weight, and funding them pulls senior candidates.
Flexible hours
Results-based scheduling is normal in services and digital teams that already work with US clients.
Wellness programs
Life insurance and meal or transport support are common; therapy access and gym reimbursements stand out.
Senior professionals in El Salvador compare offers with international employers, so a package missing private health or a training budget loses ground.
Layering benefits beats inflating base salary: acceptance rates rise, retention strengthens and total cost stays predictable.
Leave policy in El Salvador
The Código de Trabajo sets the statutory floor, and the ISSS administers the subsidies behind maternity and sick leave.
16 weeks
Paid through the ISSS subsidy for insured mothers. Job protection applies during pregnancy and the postnatal period.
3 working days
Paid by the employer for birth or adoption, taken continuously or within the first 15 days.
75% of salary
The employer pays the first 3 days; the ISSS subsidy covers 75% from day 4, for up to 52 weeks.
16 weeks
For the parent receiving the child, matching maternity leave. No general shared parental leave.
The employer files the medical certificate, holds the role through pregnancy and the postnatal window, and plans coverage for the absence.
Three days of paternity leave sits below market expectations; senior hires often expect 5 to 10 days from international employers.
Under the Labor Code, paid sick leave scales with tenure:
- 1 to under 5 months of service: 20 days
- 5 months to under 1 year: 40 days
- 1 year or more: 60 days
The budget exposure concentrates in the first 3 days of every certified illness.
Remote work regulations in El Salvador
El Salvador regulates remote work through the Ley de Regulación del Teletrabajo, in force since 2020. The services, BPO and digital sectors already run distributed teams as standard practice.
Put the telework terms in writing before the first day.
The contract or an addendum sets the telework arrangement, working hours, tools and how performance is supervised.
The employer provides the equipment needed for the work and agrees how connectivity costs are covered.
The normal limits on working time apply. Define availability windows clearly for teams across US time zones.
El Salvador approved a personal data protection law and a cybersecurity law in 2024. Set device security and data-handling rules in the agreement.
Statutory time off in El Salvador
El Salvador mandates 15 paid vacation days plus 10 national holidays. Work on a holiday pays ordinary salary plus a 100% surcharge.
Paid time off (vacation) in El Salvador
Vacation is the same at every tenure:
The employer must grant accrued leave within 4 months for companies with up to 100 workers, or 6 months above that.
El Salvador’s public holidays
El Salvador observes 10 national paid holidays under Labor Code article 190. August 6, the Feast of the Divine Savior of the World, is a national holiday, and San Salvador adds local holidays on August 3 and 5; other municipalities observe one local festivity day.
Holy Week in early April and the August 3 to 6 block fall directly on customer-facing teams covering US hours.
Popular roles to hire in El Salvador
Hiring developers in El Salvador works best when the plan fits the country’s shape: a selective engineering layer around standard enterprise stacks, and a deeper bench in customer-facing, financial operations and support roles.
Engineering teams in El Salvador
The engineering pool centers on enterprise web development, cloud and data, weighted toward Java, C# and AWS-aligned stacks, with smaller pockets in security and AI.
GTM, finance and marketing roles in El Salvador
GTM hiring works well for revenue roles tied to the US market, because the English-speaking workforce concentrates in customer service and sales.
Support, operations and HR roles in El Salvador
This is El Salvador’s deepest layer. The BPO sector trained a generation of support talent around US business hours and customer expectations.

Why should US-based B2B SaaS companies hire in El Salvador?
US SaaS companies hire in El Salvador for a near-full East Coast workday and USD payroll, without the conversion friction other Latin American markets carry. It is one of the few markets where customer-facing and revenue teams sit on the same payroll, time zone and currency as the US parent.
Time zone overlap with the US
El Salvador runs on UTC-6 all year with no daylight saving time: the same clock as US Central from November to March, and one hour behind Central the rest of the year. Matching 9 to 5 schedules give 7 hours of overlap with US Eastern in winter and 6 in summer; many Salvadoran teams start at 8, which adds an hour.
Standups, code reviews and customer escalations land inside the same business day.
Cost structure favors GTM and support
Local employers pay software developers roughly $1,600 to $2,200 a month, about one-fifth to one-seventh of the US median of $135,980 a year (BLS, May 2025). Engineers working remotely for US companies earn more, around $4,000 a month at the median, and the gap widens further for SDR, customer success and support roles.
For SaaS teams sizing pipeline coverage or customer success capacity, that is where US headcount strains the budget most.
For US B2B SaaS companies building:
- Customer success and customer support functions
- Sales development and revenue operations coverage
- Back-end and full-stack engineering capacity
- QA and test automation
- Bilingual GTM operations for the US market
Broad engineering scale-ups and specialized AI hiring belong in a larger Latin American market.
English skills and the talent pipeline
El Salvador scores 523 on the EF English Proficiency Index 2025, in the moderate band, 47th worldwide and second in Central America. English inverts the usual pattern: customer service (566) and sales (545) professionals score above IT (527), and La Libertad (542) and San Salvador (538) clear the national average. Screen in the interview, not from the resume.
Universidad Centroamericana José Simeón Cañas (UCA) trains the senior end of the engineering supply, alongside Universidad de El Salvador, Universidad Don Bosco and Universidad Francisco Gavidia, with technical baccalaureate programs feeding the operational layer.
Sourcing runs through named institutions and named employers, which favors companies hiring three to fifteen people with intent.
El Salvador’s economy
El Salvador is a services economy of about USD 36.7 billion (World Bank, 2025), with services about 59% of GDP. Remittances reached a record of nearly USD 10 billion in 2025, roughly a quarter of GDP, over 90% of it from the United States, which sustains a deep services and support layer.
Decree 722 of 2023, the Ley de Fomento a la Innovación y Manufactura de TecnologÃas, offers up to 15 years of tax exemptions for qualifying technology activities, and the Ley de Servicios Internacionales adds incentives for export IT and shared services.
Payroll carries no FX layer: the economy is fully dollarized and inflation was 3.6% year on year in September 2026. A large informal sector narrows the formal talent pool, so sourcing focuses on companies that already serve international clients.
Google opened an office in San Salvador in 2024, Tether moved its headquarters to the country in 2025, and TELUS Digital and Teleperformance run large operations there.

How to hire in El Salvador: FAQ
Is it legal for a US company to hire employees in El Salvador?
Yes. US companies have three legal routes to hire in El Salvador: setting up a local entity, using an Employer of Record (EOR), or engaging independent contractors. A hiring partner adds recruiting on top. Every employment relationship sits under the Código de Trabajo, enforced by the Ministerio de Trabajo y Previsión Social.
What is the best way to hire in El Salvador as a US company?
For a first hire or a team under ten, an EOR or a hiring partner is usually the best way to hire in El Salvador: you get compliant employment and USD payroll without opening an entity. A local entity pays off at sustained volume, and contractors suit only short, deliverable-based work because of the strict two-day presumption of employment.
How do I hire employees in El Salvador?
Choose a route, then sign a written contract in three copies and file one with the Dirección General de Trabajo within 8 days, register the employee with the ISSS within 10 days, and run monthly USD payroll with ISSS and AFP contributions and income tax withholding. An EOR or hiring partner like LatamCent can carry all of this for you.
What is the best EOR for hiring employees in El Salvador?
The right EOR employs people through its own Salvadoran entity, files contracts with the MTPS, registers workers with the ISSS and the AFP, and handles the aguinaldo, vacation premium and severance correctly. Compare quotes that show statutory costs separately from the provider fee. An EOR doesn’t recruit, so if you still need to find the person, a hiring partner that covers sourcing and compliance may fit better.
How much does an EOR cost in El Salvador?
EOR pricing is the provider’s fee on top of statutory costs. Employer contributions run about 16% to 17% on salaries up to $1,000 a month (ISSS 7.5% capped at $75, AFP 8.75%, plus 1% INSAFORP at 10 or more employees), and less on higher salaries. Add the aguinaldo and the 30% vacation premium: a $2,000 monthly salary costs about $2,358 a month before severance reserves and the EOR fee.
How do payroll services work in El Salvador?
Payroll runs in US dollars, monthly or twice a month. Each cycle covers ISSS and AFP contributions, INSAFORP for employers with 10 or more workers and income tax withholding, with the aguinaldo paid in December and vacation paid with a 30% premium. An EOR or hiring partner runs the filings so you pay one invoice.
How do I pay independent contractors in El Salvador?
Pay against invoices issued under the contractor’s own NIT, with IVA where it applies, for clearly scoped deliverables. Because the Labor Code can presume employment when services run more than two consecutive days or show subordination, document the independent relationship in writing and avoid fixed hours and exclusivity.
Do US companies need a local entity to hire in El Salvador?
No. An EOR or a hiring partner lets you hire in El Salvador without local infrastructure. A local entity fits sustained hiring volume, local invoicing or a permanent presence.
What is El Salvador’s time zone overlap with US business hours?
El Salvador runs on UTC-6 all year with no daylight saving time. Matching 9 to 5 schedules give 7 hours of overlap with US Eastern from November to March and 6 the rest of the year; many Salvadoran teams start at 8, which adds an hour.
What are the standard working hours and key employment rules in El Salvador?
Day work is 8 hours a day and 44 a week, and night work 7 hours a day and 39 a week, with night hours paid at 25% extra and overtime at a 100% surcharge. Indefinite contracts are the default, probation lasts up to 30 days, and dismissal without cause costs 30 days of salary per year of service, with the daily salary capped at four times the minimum wage.
Is August 6 a holiday in El Salvador?
Yes. August 6, the Feast of the Divine Savior of the World, is one of El Salvador’s 10 national paid holidays, and San Salvador also observes local holidays on August 3 and 5. Work on a holiday pays ordinary salary plus a 100% surcharge.
What benefits and leave are employees in El Salvador entitled to?
Statutory benefits include ISSS health and maternity coverage, AFP pension, 15 paid vacation days with a 30% premium, 10 paid public holidays, 16 weeks of maternity leave, 3 days of paid paternity leave and an aguinaldo of 15, 19 or 21 days of salary by tenure.
